A man came to Abu Musa and Salman bin Rabia and asked them about the case of a daughter, a son's daughter, and a full sister. They said, "The daughter receives half, and the full sister receives what remains." They told him, "Go to Abdullah and ask him, for he will surely agree with us."So the man went to Abdullah and mentioned the case to him, informing him of what the other two had said.Abdullah replied, "I would have gone astray then, and I would not be among those rightly guided. Rather, I will rule on this matter as the Messenger of Allah ﷺ ruled. The daughter receives half, the son's daughter receives a sixth to complete two-thirds, and the sister receives what remains."
حدثنا الحسن بن عرفة حدثنا يزيد بن هارون عن سفيان الثوري عن أبي قيس الأودي
جاء رجل إلى أبي موسى وسلمان بن ربيعة فسألهما عن الابنة وابنة الابن وأخت لأب وأم فقال للابنة النصف وللأخت من الأب والأم ما بقي وقالا له انطلق إلى عبد الله فاسأله فإنه سيتابعنا فأتى عبد الله فذكر ذلك له وأخبره بما قالا قال عبد الله قد ضللت إذا وما أنا من المهتدين ولكن أقضي فيهما كما قضى رسول الله ﷺ للابنة النصف ولابنة الابن السدس تكملة الثلثين وللأخت ما بقي
