The Messenger of Allah ﷺ said, "Whoever kills an enemy in battle and has proof of it shall have the slain man's belongings."
حدثنا الأنصاري حدثنا معن حدثنا مالك بن أنس عن يحيى بن سعيد عن عمر بن كثير بن أفلح عن أبي محمد مولى أبي قتادة
قال رسول الله ﷺ من قتل قتيلا له عليه بينة فله سلبه
Agreed upon [by Bukhari and Muslim]. Bukhari reported it in "Distribution of the Khumus," chapter "Whoever Did Not Take a Fifth of the Spoils," no. 3142, and Muslim, no. 1751, from the hadith of Malik through this route, and it is in Muwatta, 2/454, in full.There are also reports on this subject from Awf bin Malik [Muslim, no. 1753], Khalid bin Walid [Abu Dawud, no. 2721], Anas [Ahmad, 3/114, with its basis found in Muslim, no. 1809], and Samura [Ibn Majah, no. 2838].
