I heard the Messenger of Allah ﷺ say, "There is no amputation for stealing fruit or the pith of the palm tree."
حدثنا قتيبة حدثنا الليث عن يحيى بن سعيد عن محمد بن يحيى بن حبان عن عمه واسع بن حبان أن
سمعت رسول الله ﷺ يقول لا قطع في ثمر ولا كثر
Its isnad is sahih. Nasai also narrated it, 8/82, 88, hadith no. 4970 (Cutting Off the Thief's Hand, chapter on what does not require the amputation), from Qutayba with the same wording, and Ibn Jarud graded it sahih, hadith no. 826, as did Ibn Hibban, hadith no. 1505, and the hadith of Malik is found in Muwatta, 2/839 (Yahya's recension).
