The Messenger of Allah ﷺ ruled that the compensation for a miscarried fetus was a male or female slave.The man against whom the ruling was made said, "Am I to pay for one who neither drank nor ate, neither cried nor wailed? Such a case should be disregarded."The Prophet ﷺ said, "This man speaks like a poet. The compensation for it is indeed a male or female slave."
حدثنا علي بن سعيد الكندي الكوفي حدثنا ابن أبي زائدة عن محمد بن عمرو عن أبي سلمة
قضى رسول الله ﷺ في الجنين بغرة عبد أو أمة فقال الذي قضي عليه أيعطى من لا شرب ولا أكل ولا صاح فاستهل فمثل ذلك يطل فقال النبي ﷺ إن هذا ليقول بقول شاعر بل فيه غرة عبد أو أمة
[Sahih]. Abu Dawud transmitted it in the Book of Blood Money, Chapter on the Blood Money for a Miscarried Fetus, no. 4579, and Ibn Majah, no. 2639, from the hadith of Muhammad bin Amr with this same wording, and its chain is hasan. Bukhari, no. 5758, and Muslim, no. 1681, narrated it from the hadith of Abu Salama.On this topic there is also a narration from Hamal bin Malik [Abu Dawud, no. 4572] and Mughira bin Shuba [to come, no. 1411].
