A man from Hadramawt and a man from Kindah came to the Prophet ﷺ.The Hadrami said, "Messenger of Allah, this man has taken possession of land that belongs to me."The Kindi said, "It is my land. It is in my possession, and he has no right to it."The Prophet ﷺ asked the Hadrami, "Do you have evidence?"He replied, "No."The Prophet ﷺ said, "Then you are entitled only to his oath."The Hadrami said, "Messenger of Allah, the man is wicked. He does not care what he swears upon, and he abstains from nothing."The Prophet ﷺ said, "You have nothing from him but that."The man went off to swear the oath, and as he turned away, the Messenger of Allah ﷺ said, "If he swears falsely to consume his property unjustly, he will surely meet Allah while He is turned away from him."
حدثنا قتيبة حدثنا أبو الأحوص عن سماك بن حرب
جاء رجل من حضرموت ورجل من كندة إلى النبي ﷺ فقال الحضرمي يا رسول الله إن هذا غلبني على أرض لي فقال الكندي هي أرضي وفي يدي ليس له فيها حق فقال النبي ﷺ للحضرمي ألك بينة قال لا قال فلك يمينه قال يا رسول الله إن الرجل فاجر لا يبالي على ما حلف عليه وليس يتورع من شيء قال ليس لك منه إلا ذلك قال فانطلق الرجل ليحلف له فقال رسول الله ﷺ لما أدبر لئن حلف على مالك ليأكله ظلما ليلقين الله وهو عنه معرض
Muslim also narrated it, in the book of Iman, chapter on the threat against one who seizes a Muslim's right by a false oath, hadith no. 139, from Qutayba with the same wording.There is also a report on this subject from Umar [Daraqutni: 4/218, no. 4464, its chain being extremely daif], Ibn Abbas [to come at 1342], Abdullah bin Amr [to come at 1341], and Ashath bin Qays [previously at 1269, and to come at 2996, in abridged form].
