Two men brought a dispute before the Prophet ﷺ over an animal, neither of them having any evidence to support his claim, so he ruled that it be divided equally between them.
أخبرنا عمرو بن علي قال حدثنا عبد الأعلى قال حدثنا سعيد عن قتادة عن سعيد بن أبي بردة عن أبيه
أن رجلين اختصما إلى النبي ﷺ في دابة ليس لواحد منهما بينة فقضى بها بينهما نصفين
[hasan] Reported by Abu Dawud, Judgements, chapter on two men who each make a claim without having any evidence, no. 3613, from the hadith of Saeed bin Abu Aruba, with this same wording. Shuba also transmitted it, following him, as found in Bayhaqi, 10/257, and elsewhere, and it has corroborating narrations in Ibn Hibban, no. 1201, and elsewhere.
