He attributed it to the Prophet ﷺ, who said, "Whoever is killed in a blind affray, or by a stone thrown, or by a whip, or by a stick, the blood-money for him is that of accidental killing. Whoever is killed deliberately, retaliation is due. Whoever obstructs this, upon him is the curse of Allah, the angels, and all of mankind. Allah will accept from him neither obligatory nor voluntary worship."
أخبرنا محمد بن معمر قال حدثنا محمد بن كثير قال حدثنا سليمان بن كثير عن عمرو بن دينار عن طاوس
يرفعه قال من قتل في عمية أو رمية بحجر أو سوط أو عصا فعقله عقل الخطإ ومن قتل عمدا فهو قود ومن حال بينه وبينه فعليه لعنة الله والملائكة والناس أجمعين لا يقبل الله منه صرفا ولا عدلا
