Abdullah bin Abbas reported,

Among the Children of Israil there was retaliation, but no blood money among them. So Allah revealed, "Retaliation is prescribed for you in cases of murder, the free man for the free man, the slave for the slave, and the female for the female" up to His words, "But if anything is remitted to him by his brother, then let there be a fair demand and a payment made with kindness" [Baqarah 2:178].Pardon here means accepting blood money in a case of deliberate killing. "A fair demand" means that the one owed should press his claim in a fair manner, and "a payment made with kindness" means that the other should pay it with kindness. That is a concession from your Lord and a mercy, compared with what was prescribed for those before you, for with them it was only retaliation, not blood money.

قال الحارث بن مسكين قراءة عليه وأنا أسمع عن سفيان عن عمرو عن مجاهد

عن ابن عباس قال

كان في بني إسرائيل القصاص ولم تكن فيهم الدية فأنزل الله عز وجل {كتب عليكم القصاص في القتلى الحر بالحر والعبد بالعبد والأنثى بالأنثى} إلى قوله {فمن عفي له من أخيه شيء فاتباع بالمعروف وأداء إليه بإحسان} فالعفو أن يقبل الدية في العمد واتباع بمعروف يقول يتبع هذا بالمعروف وأداء إليه بإحسان ويؤدي هذا بإحسان ذلك تخفيف من ربكم ورحمة مما كتب على من كان قبلكم إنما هو القصاص ليس الدية
