A Jew saw a young girl wearing silver ornaments and killed her with a stone. She was brought to the Prophet ﷺ while she still had some life in her.He asked her, "Did so-and-so kill you?" Shuba gestured with his head, imitating her, indicating no.He asked again, "Did so-and-so kill you?" Shuba gestured with his head, imitating her, indicating no.He asked, "Did so-and-so kill you?" Shuba gestured with his head, imitating her, indicating yes.So the Messenger of Allah ﷺ summoned the man and had him killed between two stones.
أخبرنا إسمعيل بن مسعود قال حدثنا خالد عن شعبة عن هشام بن زيد
أن يهوديا رأى على جارية أوضاحا فقتلها بحجر فأتي بها النبي ﷺ وبها رمق فقال أقتلك فلان فأشار شعبة برأسه يحكيها أن لا فقال أقتلك فلان فأشار شعبة برأسه يحكيها أن لا قال أقتلك فلان فأشار شعبة برأسه يحكيها أن نعم فدعا به رسول الله ﷺ فقتله بين حجرين
Takhrij (Source Citation): It was narrated by Bukhari in the Book of Retributions, chapter, "If someone is killed with a stone or the like," hadith no. 6877, and by Muslim, Book of Qasamah, chapter on the establishment of retaliation for killing by stone and other means, etc., hadith no. 1672, from the hadith of Shuba bin Hajjaj through this chain, and it is also found in Kubra, hadith no. 6981.* Hisham bin Zayd is the son of Anas bin Malik.
