The Prophet ﷺ said, "Whoever pollinates date palms and then sells the trees, the fruit belongs to the one who pollinated them, unless the buyer stipulates otherwise."
أخبرنا قتيبة قال حدثنا الليث عن نافع
أن النبي ﷺ قال أيما امرئ أبر نخلا ثم باع أصلها فللذي أبر ثمر النخل إلا أن يشترط المبتاع
Bukhari, Sales, Chapter on Selling Palm Trees with Their Roots, no. 2206, and Muslim, Sales, Chapter on One Who Sells a Palm Tree with Fruit on It, no. 1543/79, from Qutayba with the same wording. It is also in Kubra, no. 6231.
