The Messenger of Allah ﷺ forbade muhaqala and muzabana, and said, "Only three types of people cultivate land: a man who owns land and farms it himself, a man who has been granted land and farms what was granted to him, or a man who rents land for gold or silver."Israil, narrating from Tariq, distinguished between the two parts. He transmitted the first portion as a marfu report and attributed the latter portion to the words of Saeed.
أخبرنا قتيبة قال حدثنا أبو الأحوص عن طارق عن سعيد بن المسيب
نهى رسول الله ﷺ عن المحاقلة والمزابنة وقال إنما يزرع ثلاثة رجل له أرض فهو يزرعها أو رجل منح أرضا فهو يزرع ما منح أو رجل استكرى أرضا بذهب أو فضة ميزه إسرائيل عن طارق فأرسل الكلام الأول وجعل الأخير من قول سعيد
[Its chain of transmission is hasan] Reported by Abu Dawud, no. 3400 (see the previous hadith), and Ibn Majah, chapter on Pledges, section on sharecropping for a third or a quarter, no. 2449, from the hadith of Abu Ahwas, narrated in the same manner. It is also found in Kubra, no. 4617, matching. He is Ibn Abdul-Rahman, whom the majority of scholars deemed reliable.
