The Messenger of Allah ﷺ said, "A previously married woman shall not be given in marriage until her consent is sought, and a virgin shall not be given in marriage until her permission is requested."They asked, "Messenger of Allah, how is her permission given?"He replied, "By her remaining silent."
أخبرنا محمد بن عبد الأعلى قال حدثنا خالد وهو ابن الحارث قال حدثنا هشام عن يحيى بن أبي كثير قال حدثني أبو سلمة بن عبد الرحمن قال
أن رسول الله ﷺ قال لا تنكح الأيم حتى تستأمر ولا تنكح البكر حتى تستأذن قالوا يا رسول الله كيف إذنها قال أن تسكت
Muslim narrated it, no. 1419 (see the previous hadith), from the hadith of Khalid bin Harith, and Bukhari, Book of Marriage, chapter, "A father or anyone else may not marry off a virgin or a previously married woman except with her consent," no. 5136, from the hadith of Hisham Dastawai, with the same wording, and it is in Al-Kubra, no. 5377.
