He came to us while we were in the market and said, "The Messenger of Allah ﷺ said, 'When you estimate the produce, take it and leave a third. If you do not take or leave a third'" — Shuba was uncertain — "'then leave a fourth.'"
أخبرنا محمد بن بشار قال حدثنا يحيى بن سعيد ومحمد بن جعفر قالا حدثنا شعبة قال سمعت خبيب بن عبد الرحمن يحدث عن عبد الرحمن بن مسعود بن نيار
أتانا ونحن في السوق فقال قال رسول الله ﷺ إذا خرصتم فخذوا ودعوا الثلث فإن لم تأخذوا أو تدعوا الثلث شك شعبة فدعوا الربع
Its isnad is hasan. Abu Dawud narrated it in the Book of Zakat, chapter on estimating the yield of fruit (Kharaj), no. 1605, and Tirmidhi in the Book of Zakat, chapter on what has been said about estimating the yield of fruit, no. 643, from the hadith of Shubah with the same wording. It is also found in Al-Kubra, no. 2270. Ibn Khuzayma graded it sahih, 4/442, no. 2319, 2320, as did Ibn Hibban, no. 798, and Hakim, 1/402, and Dhahabi.
