Abu Bakr bin Abdul-Rahman reported,

Asi bin Hisham died leaving three sons, two of them from the same mother and one from another mother. Then one of the two full brothers died, leaving property and freed slaves, so his full brother inherited both his property and the right of guardianship over his freed slaves. Afterwards the brother who had inherited that property and that guardianship died, leaving a son and a half brother on his father's side.The son said, "I have taken possession of everything my father took possession of, both the property and the guardianship over the freed slaves."The half brother said, "That is not so. You have taken possession of the property, but as for the guardianship over the freed slaves, no. Consider this, if my brother had died today, would I not be the one to inherit from him?"So the two of them brought their dispute to Uthman bin Affan, and he ruled that the guardianship over the freed slaves belonged to the brother.

حدثني مالك عن عبد الله بن أبي بكر بن محمد بن عمرو بن حزم

عن عبد الملك بن أبي بكر بن عبد الرحمن بن الحارث بن هشام عن أبيه أنه أخبره

أن العاصي بن هشام هلك وترك بنين له ثلاثة اثنان لأم ورجل لعلة فهلك أحد اللذين لأم وترك مالا وموالي فورثه أخوه لأبيه وأمه ماله وولاءه مواليه ثم هلك الذي ورث المال وولاء الموالي وترك ابنه وأخاه لأبيه فقال ابنه قد أحرزت ما كان أبي أحرز من المال وولاء الموالي وقال أخوه ليس كذلك إنما أحرزت المال وأما ولاء الموالي فلا أرأيت لو هلك أخي اليوم ألست أرثه أنا فاختصما إلى عثمان بن عفان فقضى لأخيه بولاء الموالي
