Malik reported,

Saeed bin Musayab was asked about a slave who had children by a free woman, to whom did the right of patronage over them belong?Saeed replied, "If their father dies while still a slave and has not been freed, then the patronage over them belongs to the patrons of their mother."

وحدثني مالك، أنه بلغه

أن سعيد بن المسيب سئل عن عبد له ولد من امرأة حرة: لمن ولاؤهم؟ فقال سعيد: إن مات أبوهم، وهو عبد لم يعتق؛ فولاؤهم لموالي أمهم.
