It reached him that Sulayman bin Yasar said the same.Malik said concerning a man who bought a share of land held jointly with others, paying for it with livestock, a male slave, a slave girl, or some similar goods, and then the partner came afterward to claim his right of preemption but found that the slave or the slave girl had died and no one knew what their value had been, the buyer states, "The value of the slave or the slave girl was a hundred dinars." Then the holder of the right of preemption may take it if he wishes, or leave it, unless the preemptor produces evidence that the value of the slave or the slave girl was less than what the buyer stated.

أنه بلغه عن سليمان بن يسار مثل ذلك. قال مالك في رجل اشترى شفصا مع قوم في أرض بحيوان: عبد أو وليدة أو ما أشبه ذلك من العروض فجاء الشريك يأخذ شفعته بعد ذلك فوجد العبد أو الوليدة قد هلكا ولم يعلم أحد قدر قيمتهما. فيقول المشتري قيمة العبد أو الوليدة مئة دينار ثم إن شاء أن يأخذ صاحب الشفعة أخذ أو ينرك، إلا أن يأتي الشفيع ببينة أن قيمة العبد أو الوليدة دون ما قال المشتري.
