The Messenger of Allah ﷺ said, "A woman who has been married before has more right over herself than her guardian, and a virgin is to be asked for her consent regarding herself, and her silence is her consent."
حدثني مالك عن عبد الله بن الفضل عن نافع بن جبير بن مطعم
أن رسول الله ﷺ قال الأيم أحق بنفسها من وليها والبكر تستأذن في نفسها وإذنها صماتها
