A man was killed during the time of the Messenger of Allah ﷺ, and the matter was brought before the Prophet ﷺ, who handed the killer over to the victim's next of kin.The killer said, "Messenger of Allah, by Allah, I did not intend to kill him."The Messenger of Allah ﷺ said to the next of kin, "If he is telling the truth and you kill him, you will enter the Fire."So he set him free. He had been bound with a leather strap, and he went out dragging his strap behind him, so he was named Dhu an-Nisah, the man of the strap.
حدثنا أبو بكر بن أبي شيبة وعلي بن محمد قالا حدثنا أبو معاوية عن الأعمش عن أبي صالح
قتل رجل على عهد رسول الله ﷺ فرفع ذلك إلى النبي ﷺ فدفعه إلى ولي المقتول فقال القاتل يا رسول الله والله ما أردت قتله فقال رسول الله ﷺ للولي أما إنه إن كان صادقا ثم قتلته دخلت النار قال فخلى سبيله قال فكان مكتوفا بنسعة فخرج يجر نسعته فسمي ذا النسعة
Sahih. Abu Dawud narrated it in the Book of Blood Money, chapter on the leader ordering pardon regarding a killing, no. 4498, from the hadith of Abu Muawiya, with this chain, and Tirmidhi graded it sahih, no. 1407.Amash's narration with "an" has already been discussed, no. 178, and some scholars' attempt to strengthen his narration from Abu Salih is not sound, as I have established in Nayl al-Maqsud, no. 517. However, his hadith has a sahih corroborating narration in Muslim, no. 1680, and Abu Dawud, no. 4501, and others.
