We came to Abu Hurayrah regarding a companion of ours who had gone bankrupt. He said, "This is the case in which the Prophet ﷺ ruled, 'Whenever a man dies or goes bankrupt, the owner of the goods has the greatest right to his goods if he finds them as they are.'"
حدثنا إبراهيم بن المنذر الحزامي وعبد الرحمن بن إبراهيم الدمشقي قالا حدثنا ابن أبي فديك عن ابن أبي ذئب عن أبي المعتمر بن عمرو بن رافع
جئنا أبا هريرة في صاحب لنا قد أفلس فقال هذا الذي قضى فيه النبي ﷺ أيما رجل مات أو أفلس فصاحب المتاع أحق بمتاعه إذا وجده بعينه
[Its chain is hasan] Abu Dawud narrated it in the Book of Business Transactions, in the chapter on a man who becomes bankrupt and another man finds his goods intact in his possession, hadith no. 3523, from the hadith of Ibn Abu Dhib, with this wording. Ibn Jarud graded it sahih, hadith no. 634, as did Hakim (2/50), and Dhahabi.Abu Mutamir was not known to Ibn Abdul-Barr, but Ibn Hibban, Ibn Jarud, and Hakim considered him reliable.
