The Prophet ﷺ said, "Whoever purchases palm trees that have already been pollinated, the fruit belongs to the seller unless the buyer stipulates otherwise."Muhammad bin Rumh narrated to us, Layth bin Saad informed us, from Nafi, from Ibn Umar, from the Prophet ﷺ, a similar report.
حدثنا هشام بن عمار حدثنا مالك بن أنس قال حدثني نافع
أن النبي ﷺ قال من اشترى نخلا قد أبرت فثمرتها للبائع إلا أن يشترط المبتاع حدثنا محمد بن رمح أنبأنا الليث بن سعد عن نافع عن ابن عمر عن النبي ﷺ بنحوه
Sourcing, Bukhari narrated it in the chapter "One who sells palm trees that have been pollinated, or cultivated land, with a rental arrangement," hadith 2204, and Muslim narrated it in "The Book of Sales," in the chapter "One who sells palm trees bearing fruit," hadith 1543, from the hadith of Malik through this chain, and both of them narrated it, Bukhari, hadith 2206, from the hadith of Layth through this chain, and Muslim, hadith 1543, from Ibn Rumh and others.
