The Messenger of Allah ﷺ said, "Whoever sells palm trees that have already been pollinated, the fruit belongs to the seller unless the buyer stipulates otherwise. And whoever buys a slave who possesses property, the property belongs to the seller unless the buyer stipulates otherwise."
حدثنا محمد بن رمح أنبأنا الليث بن سعد ح و حدثنا هشام بن عمار حدثنا سفيان بن عيينة جميعا عن ابن شهاب الزهري عن سالم بن عبد الله بن عمر
أن رسول الله ﷺ قال من باع نخلا قد أبرت فثمرتها للذي باعها إلا أن يشترط المبتاع ومن ابتاع عبدا وله مال فماله للذي باعه إلا أن يشترط المبتاع
Bukhari transmitted it in "Al-Musaqah," chapter "A man who has a right of way or a share of water in an orchard or palm grove," hadith no. 2379, and Muslim in "Al-Buyu," chapter "One who sells palm trees that have fruit on them," hadith no. 80/1543, from the hadith of Layth through this route. Muslim also transmitted it from the hadith of Sufyan bin Uyayna through this route, in abbreviated form.
