On the day of Hunayn, I saw a Muslim man fighting one of the polytheists, while another polytheist was sneaking up behind him to kill him. I rushed toward the one sneaking up. He raised his hand to strike me, and I struck his hand and cut it off. Then he seized me and squeezed me so tightly that I feared for my life, but then he let go and weakened, so I pushed him off and killed him.The Muslims were routed, and I was routed along with them. Then I came upon Umar bin Khattab among the people, and I asked him, "What is happening to the people?"He replied, "It is the decree of Allah."Then the people returned to the Messenger of Allah ﷺ, and he said, "Whoever produces evidence that he killed a slain enemy, the spoils taken from him belong to him."I stood up to look for someone to testify on my behalf about the man I had killed, but I found no one to bear witness for me, so I sat down. Then it occurred to me, and I mentioned the matter to the Messenger of Allah ﷺ. A man sitting with him said, "The weapons of this slain man he mentions are with me, so satisfy him in place of them."Abu Bakr said, "No indeed. He will not give them to a little fox of Quraysh and leave aside a lion from the lions of Allah who fights on behalf of Allah and His Messenger ﷺ."He said, The Messenger of Allah ﷺ then stood up and handed them over to me. I sold them and bought a small orchard with the proceeds, and that was the first property I acquired in Islam.
Bukhari related it in the Book of Battles (4322), saying, "Layth said, Yahya bin Saeed narrated to me, from Umar bin Kathir bin Aflah, from Abu Muhammad, the freed slave of Abu Qatada," and then he mentioned it, and this is his wording. He also gave it a connected chain in the Book of Rulings (7170), saying, "Qutayba narrated to us, Layth narrated to us," and mentioned it in abridged form.Muslim included it in the Book of Jihad (1751) from Qutayba bin Saeed with his chain of transmission, but he did not give the wording of the hadith, rather he said, "and he related the hadith," meaning the hadith that comes after it. There is a flaw here in the ordering, since a cross-reference should point to what precedes it, not to what follows it, and for this reason Nawawi also found it strange.
