When Mecca was conquered by the Messenger of Allah ﷺ, he said, "Hold back your weapons, except for Khuza against Banu Bakr." He gave them permission until he prayed Asr, then said, "Hold back your weapons."The next day, a man from Khuza encountered a man from Banu Bakr at Muzdalifa and killed him. News of this reached the Messenger of Allah ﷺ, so he stood to deliver a sermon. I saw him resting his back against the Kaabah.He said, "The most hostile of people toward Allah is one who kills within the sacred precinct, or kills someone other than his killer, or kills in vengeance for blood-feuds of the days of ignorance."A man stood up and said, "So-and-so is my son."The Messenger of Allah ﷺ replied, "There is no claim of paternity in Islam. The ways of the days of ignorance are gone. The child belongs to the marriage bed, and for the fornicator is the stone."They asked, "What is the stone?"He answered, "The rock." He continued, "For each finger, ten camels, and for each wound that exposes the bone, five camels."He also said, "There is no prayer after dawn until the sun rises, and no prayer after Asr until the sun sets. For each finger, ten camels, and for each wound that exposes the bone, five camels. There is no prayer after Subh until the sun rises, and no prayer after Asr until the sun sets. A woman is not to be married to a man alongside her paternal aunt or her maternal aunt. A woman may not give a gift except with her husband's permission. Honor the pacts of the days of ignorance, for Islam only increases them in firmness, and do not initiate new pacts in Islam."
لما فتحت مكة على رسول الله ﷺ قال: كفوا السلاح إلا خزاعة عن بني بكر فأذن لهم حتى صلى العصر ثم قال: كفوا السلاح فلقي رجل من خزاعة رجلا من بني بكر من غد بالمزدلفة فقتله، فبلغ ذلك رسول الله ﷺ فقام خطيبا فقال، ورأيته وهو مسند ظهره إلى الكعبة، قال: إن أعدى الناس على الله من قتل في الحرم أو قتل غير قاتله أو قتل بذحول الجاهلية فقام إليه رجل، فقال: إن فلانا، ابني، فقال رسول الله ﷺ: لا دعوة في الإسلام، ذهب أمر الجاهلية، الولد للفراش، وللعاهر الأثلب قالوا: وما الأثلب؟ قال: الحجر قال: وفي الأصابع عشر عشر وفي المواضح خمس خمس قال: وقال: لا صلاة بعد الغداة حتى تطلع الشمس ولا صلاة بعد العصر حتى تغرب الشمس قال: ولا تنكح المرأة على عمتها ولا على خالتها ولا يجوز لمرأة عطية إلا بإذن زوجها. وفي رواية: لما فتح على رسول الله ﷺ مكة قال: كفوا السلاح إلا خزاعة عن بني بكر فأذن لهم حتى صلوا العصر، ثم قال: كفوا السلاح فلقي من الغد رجل من خزاعة رجلا من بني بكر بالمزدلفة فقتله، فبلغ ذلك رسول الله ﷺ فقام خطيبا فقال: إن أعدى الناس على الله من عدا في الحرم ومن قتل غير قاتله ومن قتل بذحول الجاهلية فقال رجل: يا رسول الله، إن ابني فلانا عاهرت بأمه في الجاهلية؟ فقال: لا دعوة في الإسلام ذهب أمر الجاهلية، الولد للفراش وللعاهر الأثلب قيل: يا رسول الله، وما الأثلب؟ قال: الحجر، وفي الأصابع عشر عشر، وفي المواضح خمس خمس، ولا صلاة بعد الصبح حتى تشرق الشمس، ولا صلاة بعد العصر حتى تغرب الشمس، ولا تنكح المرأة على عمتها ولا على خالتها، ولا يجوز لمرأة عطية إلا بإذن زوجها، أوفوا بحلف الجاهلية، فإن الإسلام لم يزده إلا شدة، ولا تحدثوا حلفا في الإسلام.
Ahmad (6692, 6933, 6681), Ibn Jarud (1052), and Bayhaqi (2542) all narrated it through various chains from Amr bin Shuayb, from his father, from his grandfather, mentioning it both at length and in brief. In some of these chains Muhammad bin Ishaq appears, but he explicitly stated that he heard it directly from Amr bin Shuayb. Moreover, he was not alone in narrating it, for he was corroborated by Husayn Muallim and others.Its chain of transmission is hasan because of Amr bin Shuayb, whose hadith is hasan. He alone mentioned the phrase "so he gave them permission until the time of Asr prayer," and I have not found any corroboration for this in the Sunan or the Masanid.
