He said during the time of the conquest, "Messenger of Allah, where will we stay tomorrow?"The Prophet ﷺ replied, "Has Aqeel left us any house at all?"Then he said, "A Muslim does not inherit from a disbeliever, nor does a disbeliever inherit from a Muslim."Zuhri was asked, "Who inherited from Abu Talib?"He replied, "Aqeel and Talib inherited from him."
أنه قال زمن الفتح: يا رسول الله أين ننزل غدا؟ قال النبي ﷺ: وهل ترك لنا عقيل من منزل؟ ثم قال: لا يرث المؤمن الكافر، ولا يرث الكافر المؤمن قيل للزهري: من ورث أبا طالب؟ قال: ورثه عقيل وطالب.
Bukhari narrated it in the Book of Military Expeditions (4282, 4283), and Muslim narrated it in the Book of Hajj (440:1351) for the first part, while the second part is in the Book of Inheritance Shares (1614:1). Both narrated it through Zuhri, from Ali bin Husayn, from Amr bin Uthman, from Usama bin Zayd, who said, and he related it.
