He heard Umar bin Abdul-Aziz asking Saaib bin Yazid, "Have you heard anything regarding staying in Mecca?"Saaib replied, "I heard Ala bin Hadrami say, 'I heard the Messenger of Allah ﷺ say, "An emigrant may stay three days after completing the rites,"' as if he meant that he should not exceed that."
أنه سمع عمر بن عبد العزيز يسأل السائب بن يزيد يقول هل سمعت في الإقامة بمكة شيئا؟ فقال السائب: سمعت العلاء بن الحضرمي يقول: سمعت رسول الله ﷺ يقول: للمهاجر إقامة ثلاث بعد الصدر. كأنه يقول: لا يزيد عليها.
Bukhari narrated it in the Merits of the Ansar (3933), and Muslim in Hajj (1352), both through chains of transmission from Humayd bin Abdul-Rahman, who related it.Bukhari's version does not include, "as if he were saying, he should not exceed it." His statement, "after the return," means after coming back from Mina. This ruling is specific to those who emigrated from Makkah to Madinah, because the era of the Prophet ﷺ was a time of jihad and the founding of the Islamic state.
