I said, "Messenger of Allah, I shoot at game and then find my arrow in it the next day."He replied, "If you know that your arrow killed it and you see no trace of a wild beast on it, then eat it."
قلت: يا رسول الله، أرمي الصيد فأجد فيه من الغد سهمي؟ قال: إذا علمت أن سهمك قتله، ولم تر فيه أثر سبع فكل.
Tirmidhi (1468) and Nasai (4312) narrated it through the route of Shubah, and Nasai (4311) and Ahmad (19369) through the route of Hushaym, both of them from Abu Bishr, from Saeed bin Jubayr, from Adi bin Hatim, and he mentioned it. Its chain of transmission is sahih, and Abu Bishr, Jafar bin Iyas Yashkuri, is trustworthy, one of the most reliable narrators when it comes to Saeed bin Jubayr. Tirmidhi said, "This is a hasan sahih hadith, and this is the practice among the people of knowledge."As for what was narrated from Adi bin Hatim, who said, "I asked the Messenger of Allah ﷺ about the game caught by a hawk, and he said, 'Whatever it catches and holds for you, eat it,'" this is shadhdh (irregular) in its mention of the hawk. Tirmidhi (1467) narrated it through the route of Isa bin Yunus, from Mujalid, from Shaybi, from Adi bin Hatim, and he mentioned it. Abu Dawud (2851) and Ahmad (18258) narrated it through the route of Abdullah bin Numayr, who said, we were told by Mujalid, with the same chain, and they both mentioned it at length, with Ahmad's version being longer, and it contains, "We are a people who hunt with these dogs and hawks, so what is lawful for us from them?" Tirmidhi said, "This is a hadith we do not know except through the report of Mujalid from Shaybi." Bayhaqi (9/238) narrated it through the route of Abu Dawud, then said, "The mention of the hawk in this report was not brought by the reliable memorizers from Shaybi, rather it was brought only by Mujalid." I say, Mujalid is Ibn Saad Hamdani Kufi, and he is daif.Likewise, what was narrated from Jabir bin Abdullah is not sound, where he said, "We were forbidden from the game caught by the dog of the Magians." Tirmidhi (1466) and Ibn Majah (3209) narrated it through the route of Waki, who said, we were told by Sharik, from Hajjaj bin Artah, from Qasim bin Abu Bazza, from Sulayman Yashkuri, from Jabir bin Abdullah, and he mentioned it. Its chain of transmission is daif, containing two flaws. Sharik is Ibn Abdullah Nakhai, the judge, who has weak memory, and Hajjaj bin Artah is a mudallis (one who conceals defects in transmission) and he transmitted this with an ambiguous formula of narration (anana). For this reason Tirmidhi weakened it, saying, "A gharib (rare) hadith which we do not know except through this route." He said, "This is the practice among most of the people of knowledge, they do not permit the game caught by the dog of the Magians."Ibn Abdul-Barr said in al-Istidhkar (15/295-296), "As for the game caught by a Muslim using a Magian's dog, the disagreement over it is old. One group disliked it and did not permit it, while others permitted it. Among those who disliked it were Jabir bin Abdullah, the companion of the Messenger of Allah ﷺ, Hasan Basri, Ataa, Mujahid, Ibrahim Nakhai, and Sufyan Thawri, and this is the view held by Ishaq bin Rahawayh... Others opposed them, saying that the training given by a Magian and the training given by a Muslim are the same, and that the dog is merely like an instrument of slaughter and ritual killing. Among those who held this view were Saeed bin Musayab, Ibn Shihab, Hakam, and Ataa, this being the more correct view attributed to him, and it is the position of Malik, Shafii, Abu Hanifa, and their followers."
