The Messenger of Allah ﷺ said, "If he becomes drunk, flog him. Then if he becomes drunk again, flog him. Then if he becomes drunk again, flog him. But if he returns to it a fourth time, kill him."
قال رسول الله ﷺ: إذا سكر فاجلدوه، ثم إن سكر فاجلدوه، ثم إن سكر فاجلدوه، فإن عاد الرابعة فاقتلوه.
Reported by Abu Dawud (4484), Nasai (5662), Ibn Majah (2572), and Ahmad (7911), and graded sahih by Ibn Hibban (4447), Hakim (4/371), and Bayhaqi (8/313), all of them from the hadith of Ibn Abu Dhib, from Harith bin Abdul-Rahman, from Abu Salama, from Abu Hurairah, who related it. Its chain is hasan because of Harith bin Abdul-Rahman Qurashi Amiri, the maternal uncle of Ibn Abu Dhib, for he is hasan al-hadith.Ahmad added, Zuhri said, then the Messenger of Allah ﷺ was brought a drunk man for the fourth time and he let him go.Hakim also reported it (4/371) through another route, from Saeed bin Abu Aruba, from Suhayl bin Abu Salih, from his father, from Abu Hurairah, who related the same. He said, "Sahih according to the criterion of Muslim."Abdul-Razzaq reported it (17081) from Mamar, from Suhayl bin Abu Salih, from his father, from Abu Hurairah, with the same wording. Nasai transmitted it in Kubra (5296) through this route.Mamar said, "I mentioned that to Ibn Munkadir, and he said, 'Execution has indeed been abandoned. The Prophet ﷺ was brought the son of Nuayman and he flogged him, then he was brought to him again and he flogged him, then he was brought to him again and he flogged him, then he was brought to him a fourth time and he flogged him, or more.'"Tirmidhi said, "This is how the hadith of Muawiya goes. Thawri likewise narrated it from Asim, from Abu Salih, from Muawiya, from the Prophet ﷺ. Ibn Jurayj and Mamar narrated it from Suhayl bin Abu Salih, from his father, from Abu Hurairah, from the Prophet ﷺ." He said, "I heard Muhammad say, 'The hadith of Abu Salih from Muawiya from the Prophet ﷺ on this matter is more sahih than the hadith of Abu Salih from Abu Hurairah from the Prophet ﷺ.'" End of quote.Daraqutni likewise gave preference to the hadith of Abu Salih from Muawiya in Ilal (10/91).I say, this is the view of these two great imams, but according to the principles of hadith criticism, I see nothing preventing Abu Salih from having two teachers among the companions, namely Muawiya and Abu Hurairah. And Allah, the Exalted, knows best.
