The Prophet ﷺ said, "There is no amputation upon one who breaches a trust, nor upon one who openly seizes property, nor upon one who snatches it away."
عن النبي ﷺ قال: ليس على خائن، ولا منتهب، ولا مختلس قطع.
Abu Dawud (4393/4392/4391), Tirmidhi (1448), Ibn Majah (2591), and Nasai (4973) all narrated it, and Ibn Hibban (4456) and Bayhaqi (289/8) graded it sahih. All of them transmitted it through the routes of Ibn Jurayj, from Abu Zubayr, from Jabir, who related it. The wording given here is that of Tirmidhi, and some of them split up the text of the hadith. Tirmidhi said, "hasan sahih," but the scholars disputed the soundness of this hadith.Abdul-Rahman bin Abu Hatim said, I asked my father and Abu Zura about a hadith narrated by Ibn Jurayj, from Abu Zubayr. They said, "Ibn Jurayj did not hear this hadith from Abu Zubayr. It is said that he heard it from Yasin, and I told it to Ibn Jurayj on the authority of Abu Zubayr." So I said to them, "What is the status of Yasin?" They said, "He is not strong." End of quote.Abu Dawud, after splitting its text into two hadiths, said, "Ibn Jurayj did not hear these two hadiths from Abu Zubayr. It has reached me from Ahmad bin Hanbal that he said, Ibn Jurayj only heard them from Yasin Zayyat." Abu Dawud said, "Mughira bin Muslim narrated both of them from Abu Zubayr, from Jabir, from the Prophet ﷺ." End of quote. This is a rebuttal of the criticism directed at the hadith through Ibn Jurayj, since Mughira corroborates Ibn Jurayj.The hadith of Mughira bin Muslim, from Abu Zubayr, was narrated by Nasai (4975), except that in Sunan al-Kubra (4/348) he said, "Mughira bin Muslim is not strong in his narrations from Abu Zubayr, and he has more than one munkar hadith." He also said, "This hadith was narrated from Ibn Jurayj by Isa bin Yunus, Fadl bin Musa, Ibn Wahb, Muhammad bin Rabia, Makhlad bin Yazid, and Salama bin Saeed, a trustworthy Basran," Ibn Abu Safwan said, "and he was the best person of his time," "yet none of them said in it, 'Abu Zubayr told me,' and I do not think he heard it from Abu Zubayr." This is what he, may Allah have mercy on him, said.He himself narrated it in Sunan al-Kubra, saying, "Muhammad bin Hatim informed us, he said, Suwayd informed us, he said, Abdullah informed us, from Ibn Jurayj, who said, Abu Zubayr informed me, from Jabir," and he related the hadith. But he also said, "It carries no weight, since Ibn Jurayj did not hear it from Abu Zubayr, as far as we know."Abdul-Razzaq (18844) narrated it from Ibn Jurayj, who said, Abu Zubayr said to me, Jabir bin Abdullah said, and he related the hadith. This contains an explicit statement from Ibn Jurayj that he heard it directly from Abu Zubayr.As for the hadith of Yasin bin Zayyat, Abdul-Razzaq narrated it from him, that he heard Abu Zubayr relating from Jabir, from the Messenger of Allah ﷺ, and he related the hadith. This contains an explicit statement from Abu Zubayr that he heard it from Jabir bin Abdullah.Darimi (2356) narrated it from Abu Asim, from Ibn Jurayj, who said, Abu Zubayr informed us, Jabir said, the Messenger of Allah ﷺ said, and he related the hadith. Nasai did not come across this narration of Abu Asim from Ibn Jurayj, and it contains an explicit statement from Ibn Jurayj of having heard this hadith from Abu Zubayr.In summary, this is a sahih hadith. Ibn Hibban graded it sahih, and Abdul-Haqq passed over it in silence in his Ahkam, as did Ibn Qattan after him, so it is sahih according to both of them, as Zaylai (364/3) stated. He said, "Tirmidhi's grading it sahih indicates that its continuous transmission was established." He then cited two supporting witnesses for it, from the hadith of Abdul-Rahman bin Awf and from the hadith of Anas, both of which follow.
