The Messenger of Allah ﷺ was asked about fruit still hanging on the tree. He said, "Whoever, being in need, eats from it with his mouth without taking any away in a container, there is nothing against him. But whoever carries any of it away, he must pay a fine of twice its value along with a punishment. And whoever steals any of it after it has been gathered into the drying place, and the value reaches the price of a shield, his hand is to be cut off."He mentioned regarding stray camels and sheep what others have mentioned.He was also asked about lost property. He said, "Whatever is found on a frequented road or in an inhabited village, announce it for a year. If its owner comes, hand it over to him, and if no one comes, it is yours. As for what is found in ruins," meaning desolate places, "in it and in buried treasure, a fifth is due."
عن رسول الله ﷺ أنه سئل عن الثمر المعلق فقال: من أصاب بفيه من ذي حاجة غير متخذ جبنة فلا شيء عليه، ومن خرج بشيء منه، فعليه غرامة مثليه والعقوبة، ومن سرق منه شيئا بعد أن يؤويه الجرين فبلغ ثمن المجن فعليه القطع. وذكر في ضالة الإبل والغنم كما ذكره غيره. قال: وسئل عن اللقطة فقال: ما كان منها في طريق الميتاء، أو القرية الجامعة فعرفها سنة، فإن جاء طالبها فادفعها إليه، وإن لم يأت فهي لك. وما كان في الخراب يعني ففيها وفي الركاز الخمس.
Abu Dawud (1710), Tirmidhi (1288), Nasai (4958), and Ibn Majah (2596) all narrated it from Qutayba bin Saeed, who said, Layth narrated to us, from Ibn Ajlan, from Amr bin Shuayb, from his father, from his grandfather Abdullah bin Amr bin As, and he related the hadith. Ibn Majah alone narrated it by another route, from Walid bin Kathir, from Amr bin Shuayb. The wording given here is Abu Dawud's, while the others narrated it in abridged form.Hakim (4/381) also narrated it by another route from Amr bin Shuayb with his chain, similarly, and said, "This is a sunnah that Amr bin Shuayb bin Muhammad related alone, from his father, from his grandfather Abdullah bin Amr bin As. When the narrator from Amr bin Shuayb is trustworthy, it is like Ayub narrating from Nafi, from Ibn Umar." End of quote. Its chain is hasan because of Amr bin Shuayb.Imam Ahmad (6683) narrated it in full by another route, from Muhammad bin Ishaq, from Amr bin Shuayb, from his father, from his grandfather. Muhammad bin Ishaq is a mudallis and narrated with "an" phrasing, but he was corroborated by another narrator.
