I obtained a divorce from my husband through khul, then I came to Uthman and asked, "What waiting period do I have to observe?"He replied, "You have no waiting period upon you, unless you have recently been with him, in which case you stay with him until you have one menstrual cycle."She said, "He was only following in this the ruling of the Messenger of Allah ﷺ regarding Maryam al-Mughaliyyah, who had been married to Thabit bin Qays and obtained a khul divorce from him."
اختلعت من زوجي ثم جئت عثمان فسألت: ماذا على من العدة؟ فقال: لا عدة عليك، إلا أن يكون حديث عهد بك، فتمكثين عنده حتى تحيضين حيضة. قالت: وإنما تبع ذلك قضاء رسول الله ﷺ. في مريم المغالية، وكانت تحت ثابت بن قيس فاختلعت منه.
Narrated by Nasai (3498) and Ibn Majah (2058), both from the hadith of Ibrahim bin Saad, from Muhammad bin Ishaq, who said, "Ubada bin Walid bin Ubada bin Samit narrated to me," and he related it. Its isnad is hasan because of Muhammad bin Ishaq.As for his statement, "There is no waiting period upon you, unless it is a recent union with you," this means that the woman who seeks khula does not owe a waiting period like that of the divorced woman, except for a single menstrual cycle for the purpose of clearing the womb, if the marriage was recent, through his having consummated it with you, or through intercourse, such that you remained with him. Otherwise, there is no waiting period upon you.However, this is contradicted by what appears in the hadith of Ibn Abbas as recorded by Abu Dawud and others, that he ordered her to observe a waiting period of one menstrual cycle. This should be understood in light of the prevailing ruling, namely that he had presumably had intercourse with her, so she observes a waiting period of one menstrual cycle to clear the womb.
