I heard the Messenger of Allah ﷺ forbid that a man be married to a woman and her maternal aunt at the same time, or to a woman and her paternal aunt at the same time.
سمعت رسول الله ﷺ ينهى أن يجمع بين المرأة وخالتها، وبين المرأة وعمتها.
Ibn Majah (1930), Ahmad (11637), Ibn Nasr Marwazi in Sunnah (242), and Ibn Abu Shayba (4/246) all narrated it, each of them through the hadith of Muhammad bin Ishaq, from Yaqub bin Abdullah bin Utba, from Sulayman bin Yasar, from Abu Saeed Khudri, who mentioned it within a long hadith. Muhammad bin Ishaq explicitly stated "hadaana" with Marwazi, and his narration is hasan when he states it explicitly, which is the case here.On the same subject is what was narrated from Ibn Umar, from the Prophet ﷺ, who said, "A woman must not be married while her paternal aunt is already married to the same man, nor while her maternal aunt is." This was narrated by Ibn Hibban (5996) within a long account, through the hadith of Sinan bin Harith bin Musrif, from Talha bin Musarrif, from Mujahid, from Ibn Umar, who mentioned it. The author mentioned Sinan bin Harith in Thiqaat (6/424), and Ibn Abu Hatim mentioned him in Jarh wa Tadil (4/254) without saying anything about him, so he falls among the unknown narrators.However, Bazzar in Kashf Astar (1436), Tirmidhi in Ilal al-Kabir (1/441), and Marwazi in Sunnah (250) all narrated it through the hadith of Kathir bin Hisham, who said, Jafar bin Barqan told us, from Zuhri, from Salim, from his father, who said, "The Messenger of Allah ﷺ forbade two kinds of marriage, that a woman be married while her paternal aunt is married to the same man, or while her maternal aunt is."Bazzar said, "We do not know of anyone who narrated it from Zuhri in this manner except Abu Jafar, nor from him except Kathir." Tirmidhi said, "I asked Muhammad about this hadith, and he said, 'It is a mistake. It is actually narrated from Zuhri, from Qabisa bin Zuayb, from Abu Hurairah.'" I say, the narration of Zuhri from Qabisa, from Abu Hurairah, is found in the Sahihayn as mentioned previously.Ibn Abu Hatim said, "I asked my father about a hadith narrated by Kathir bin Hisham, from Jafar bin Barqan, from Zuhri, from Salim, from his father, from the Prophet ﷺ, that he forbade a man from sitting at a table where wine is being drunk, and that a woman be married while her paternal aunt is married to the same man. My father said, 'These two hadiths are mistaken. He narrates it from Jafar, from a man, from Zuhri in this manner, but this is not from the hadith of Zuhri. As for the hadith, "He forbade that a woman be married while her paternal aunt is married to the same man or while her maternal aunt is," Uqayl narrated it from Zuhri, from Ubaydullah bin Abdullah, and Qabisa bin Zuayb, from Abu Hurairah, from the Prophet ﷺ, and this is more likely to be correct. As for the story of the table, it is fabricated and not from the hadith of the reliable narrators.'" Ilal (1/402–403).I say, the flaw in this hadith is Jafar bin Barqan Kullabi. He is reliable, one of the trustworthy narrators among the Muslims, as Ibn Uyayna said, but he is inconsistent in his narration from Zuhri, as Imam Ahmad, Ibn Main, Nasai, Ibn Adi, Aqeeli, and other authorities in this field have explicitly stated. The reliable and precise narrators contradicted him in this narration, narrating it instead from Zuhri, from Qabisa, from Abu Hurairah.On this subject also is what was narrated from Abu Musa Ashari, who said, the Messenger of Allah ﷺ said, "A woman must not be married while her paternal aunt is married to the same man, nor while her maternal aunt is." This was narrated by Ibn Majah (1931), from Jabarah bin Mughallas, who said, Abu Bakr Nahshali told us, who said, Abu Bakr bin Abu Musa told me, from his father, who mentioned it. Its chain of transmission is daif because of Ibn Majah's teacher, Jabarah bin Mughallas, on whose weakness the authorities of criticism agreed, to the point that Daraqutni said, "Discarded."On this subject also is what was narrated from Ali, who said, the Messenger of Allah ﷺ said, "A woman must not be married while her paternal aunt is married to the same man, nor while her maternal aunt is." This was narrated by Ahmad (577), Bazzar in Kashf Astar (1434), Abu Yaala (360), and Marwazi in Sunnah (249), all of them through the hadith of Abdullah bin Lahia, who said, Abdullah bin Hubayra told us, from Abdullah bin Razin, from Ali bin Abu Talib, who mentioned it. Bazzar said, "We do not know of it being narrated from Ali except through this chain." I say, the chain contains Abdullah bin Lahia, about whom there is well known discussion.On this subject also is what was narrated from Itaab bin Usayd, Saad bin Abu Waqqas, and others, but all of these are flawed.
