Fatimah bint Qays, the sister of Dahhak bin Qays, reported that Abu Hafs Ibn Mughira al-Makhzumi divorced her three times, then set off for Yemen. His family told her, "We owe you no maintenance."So Khalid bin Walid went with a group of men to the Messenger of Allah ﷺ at the house of Maymunah and said, "Abu Hafs has divorced his wife three times. Is she entitled to maintenance?"The Messenger of Allah ﷺ replied, "She is not entitled to maintenance, but she must observe the waiting period."He then sent word to her, "Do not act regarding yourself before consulting me." And in another wording, "Do not commit yourself without informing us."
أن فاطمة بنت قيس- أخت الضحاك بن قيس- أخبرته أن أبا حفص ابن المغيرة المخزومي طلقها ثلاثا. ثم انطلق إلى اليمن. فقال لها أهله: ليس لك علينا نفقة فانطلق خالد بن الوليد في نفر، فأتوا رسول الله ﷺ في بيت ميمونة. فقالوا: إن أبا حفص طلق امرأته ثلاثا، فهل لها من نفقة؟ فقال رسول الله ﷺ: ليست لها نفقة، وعليها العدة وأرسل إليها: أن لا تسبقيني بنفسك… الحديث. وفي لفظ: لا تفوتينا بنفسك.
Muslim narrated it in the Book of Divorce (38:1480) from Muhammad bin Rafi, who said, our teacher told us Muhammad, who told us Shayban, from Yahya (that is, Ibn Abu Kathir), Abu Salama told me, and he related it.The other wording comes through Muhammad bin Amr, from Abu Salama, with the same account. Ibn Hajar in Fath al-Bari (9/179) attributed this wording to Abu Dawud alone, which is an oversight.His saying, "Do not get ahead of me," contains an indirect allusion to a marriage proposal.The jurisprudence of the hadith, Ibn Hajar said, the scholars agree that a woman whose husband has died falls under this ruling, but they differ regarding a woman in the waiting period after an irrevocable divorce, and likewise a woman whose marriage contract has been suspended. As for a woman in a revocable divorce, Shafii said, "No one may make an indirect allusion to a marriage proposal with her."Ibn Hajar said, "The conclusion is that an explicit marriage proposal is forbidden for all women in a waiting period, while an indirect allusion is permitted for the first category, forbidden in the last, and disputed regarding the woman in an irrevocable divorce."
