The Messenger of Allah ﷺ said, "An orphan girl is to be consulted concerning herself in marriage. If she remains silent, that is her consent, and if she refuses, she is not to be forced."
قال رسول الله ﷺ: تستأمر اليتيمة في نفسها، فإن سكتت فقد أذنت، وإن أبت لم تكره.
Ahmad (9516) and Bazzar - Kashf Astar (1423) narrated it, and Ibn Hibban (4085) and Hakim (2/166) graded it sahih, and from him Bayhaqi (7/122) narrated it, all of them from the hadith of Yunus bin Abu Ishaq, from Abu Burda, from his father Abu Musa, who related it.Its chain of transmission is hasan, due to the discussion surrounding Yunus bin Abu Ishaq, though his hadith is hasan. Even though his son Israil bin Yunus is more reliable than him regarding Abu Ishaq, the scholars nevertheless accepted his narration from his father.Hakim said, "Sahih according to the standard of the two shaykhs (Bukhari and Muslim)." But Yunus bin Abu Ishaq is not among the narrators of Bukhari.
