The Messenger of Allah ﷺ said, "The orphan girl is to be consulted regarding herself. If she remains silent, that is her consent, and if she refuses, no authority can be exercised over her." That is, once she reaches maturity and refuses.
قال رسول الله ﷺ: واليتيمة تستأمر في نفسها، فإن صمتت فهو إذنها، وأن أبت فلا جواز عليها يعني إذا أدركت فردت.
Abu Dawud (2093), Tirmidhi (1109), Nasai (237), and Ahmad (7572) all narrated it, and Ibn Hibban graded it sahih (4086, 4079). All of them narrated it through a group of narrators from Muhammad bin Amr, from Abu Salama, from Abu Hurairah, and he mentioned it. Its chain is hasan, as Tirmidhi said, because of the discussion concerning Muhammad bin Amr, who is Ibn Alqama Laythi, and he is hasan al-hadith.Abu Dawud also narrated it (2094) from Muhammad bin Ala, who said, Ibn Idris narrated to us from Muhammad bin Amr, with this hadith and its chain, adding to it, he said, "If she weeps or remains silent," adding the word "weeps." Abu Dawud said, "'Weeps' is not preserved, and it is a mistake in the hadith, and the mistake comes either from Ibn Idris or from Muhammad bin Ala."
