Uthman bin Mazun died and left behind a daughter from Khuwayla bint Hakeem bin Umaya bin Haritha bin al-Awqas. He had appointed his brother Qudama bin Mazun as her guardian.Abdullah said, "They were both my maternal uncles."He continued, "I proposed to Qudama bin Mazun for the daughter of Uthman bin Mazun, and he married her to me. Then Mughira bin Shuba approached her mother, enticing her with wealth, so she leaned toward him, and the girl inclined toward her mother's wish. They both refused the marriage, and the matter was brought before the Messenger of Allah ﷺ."Qudama bin Mazun said, "Messenger of Allah, she is my brother's daughter, entrusted to my care. I married her to her cousin Abdullah bin Umar, and I did not fall short regarding her in terms of righteousness or suitability. But she is only a woman, and she has merely leaned toward her mother's preference."The Messenger of Allah ﷺ said, "She is an orphan, and she shall not be married except with her own consent."Abdullah said, "By Allah, she was taken from me after I had already taken possession of her, and they married her to Mughira."
توفي عثمان بن مظعون، وترك ابنة له من خويلة بنت حكيم بن أمية بن حارثة بن الأوقص، قال: وأوصى إلى أخيه قدامة بن مظعون، قال عبد الله: وهما خالاي، قال: فخطبت إلى قدامة بن مظعون ابنة عثمان بن مظعون، فزوجنيها ودخل المغيرة بن شعبة- يعني إلى أمها- فأرغبها في المال، فحطت إليه، وحطت الجارية إلى هوى أمها، فأبيا، حتى ارتفع أمرهما إلى رسول الله ﷺ فقال قدامة بن مظعون: يا رسول الله، ابنة أخي، أوصى بها إلي، فزوجتها ابن عمتها عبد الله بن عمر، فلم أقصر بها في الصلاح ولا في الكفاءة، ولكنها امرأة وإنما حطت إلى هوى أمها. قال: فقال رسول الله ﷺ: هي يتيمة ولا تنكح إلا بإذنها قال: فانتزعت والله منى بعد أن ملكتها، فزوجوها المغيرة.
Imam Ahmad (6136) narrated it from Yaqub, who said, my father narrated to us, from Ibn Ishaq, who said, Umar bin Husayn bin Abdullah, the client of the family of Hatib, narrated to me, from Nafi, the client of Abdullah bin Umar, from Abdullah bin Umar, and he related it. Its chain is hasan because of Muhammad bin Ishaq.Daraqutni also narrated it (3/230), and from him Bayhaqi (7/120), by another route from Muhammad bin Ishaq, in the same manner. Ibn Abu Dhib followed him, from Umar bin Husayn with his chain, in an abbreviated form that does not mention the story of Mughira bin Shuba, containing only this, that her mother went to the Prophet ﷺ and said, "My daughter dislikes that." So the Prophet ﷺ ordered him to separate from her. So he separated from her, and he said, "Do not marry off orphan girls until you consult them, and if she remains silent, that is her consent." She then married, after Abdullah, Mughira bin Shuba.Daraqutni narrated it through the route of Muhammad bin Ismail bin Abu Fudayk, who said, Ibn Abu Dhib narrated to us, and Hakim (2/167), and from him Bayhaqi (7/121), both from the hadith of Ibn Abu Fudayk, in the same manner. Hakim said, "Sahih according to the standard of the two Shaykhs."If this is sound, then it does no harm that Ibn Ishaq, in one narration, relates it from Nafi, from Ibn Umar, for the correct position is that he relates it from Umar bin Husayn, from Nafi. Umar bin Husayn is trustworthy, Nasai and others deemed him trustworthy. Likewise, the disagreement over Ibn Abu Dhib does no harm, for the narration of Ibn Abu Fudayk from him has no defect in it, and Hakim graded it sahih as mentioned before.As for what Walid bin Muslim and Sadaqa bin Abdullah narrated, from Ibn Abu Dhib, from Nafi, from Ibn Umar, the correct version is from Umar bin Husayn, from Nafi, from Ibn Umar. Daraqutni pointed to this defect in his Sunan, and Ibn Abdul-Hadi quoted it from him in al-Tanqih (4/309), as Ibn Jawzi also quoted in al-Tahqiq maa al-Tanqih (4/113), his statement that when Ahmad was asked about this hadith, he said, "Void." Perhaps he meant by this the story that Ibn Ishaq mentioned, for others confined themselves to mentioning the raised portion without the story of Mughira bin Shuba, for in it there is something that should be rejected against him.
