He said, Muaz bin Jabal came to us in Yemen as a teacher and a governor. We asked him about a man who died leaving behind his daughter and his sister, and he gave the daughter half and the sister half.
قال أتانا معاذ بن جبل باليمن معلما وأميرا، فسألناه عن رجل توفي، وترك ابنته وأخته، فأعطى الابنة النصف، والأخت النصف.
Bukhari narrated it in the Book of Inheritance (6734) from Mahmud, who said, Abu Nadr told us, Abu Muawiya Shayban told us, from Ashath, from Aswad, and he mentioned it. His statement, "as a teacher and governor," indicates that he is describing what took place during the lifetime of the Prophet ﷺ, since it was he who had sent him as a teacher and governor.More explicit than this is what Abu Dawud narrated (2893) through another route, from Abu Hassan, from Aswad bin Yazid, that Muaz bin Jabal gave a ruling of inheritance for a sister and a daughter, assigning each of them half, while he was in Yemen, and the Prophet of Allah ﷺ was still alive at that time.Zayd bin Thabit said, "If a man or woman leaves behind a daughter, she gets half. If there are two daughters or more, they get two-thirds. If there is a male among them, one begins with whoever shares with them, giving him his due share, and whatever remains goes to the male, who gets a share equal to that of two females."Bukhari mentioned this in the chapter on the inheritance of a child from his father and mother.
