Umar bin Khattab summoned him. He said, I set out and went in to him, and his chamberlain Yarfa came to him and said, "Will you see Uthman, Abdul-Rahman, Zubayr, and Saad?"Umar said, "Yes."So he admitted them. Then Yarfa said, "Will you see Ali and Abbas?"Umar said, "Yes."Abbas said, "Commander of the Faithful, judge between me and this man."Umar said, "I ask you by Allah, by whose permission the heavens and the earth stand firm, do you know that the Messenger of Allah ﷺ said, 'We are not inherited from. What we leave behind is charity'? By this the Messenger of Allah ﷺ meant himself."The group said, "He did say that."Then Umar turned to Ali and Abbas and said, "Do you two know that the Messenger of Allah ﷺ said that?"They said, "He did say that."Umar said, "Then let me tell you about this matter. Allah singled out His Messenger with something from this spoil that He gave to no one else. Allah said, 'And what Allah restored to His Messenger' to His words 'is capable of all things' [Hashr 59:6]. So it belonged exclusively to the Messenger of Allah ﷺ. Yet by Allah, he did not hoard it away from you, nor did he take it for himself in preference to you. He gave it to you and distributed it among you until only this property remained of it. The Prophet ﷺ would spend from this property on his family for a year's maintenance, then take what was left and place it where the wealth of Allah is placed. The Messenger of Allah ﷺ acted in this way all his life. I ask you by Allah, do you know this?"They said, "Yes."Then he said to Ali and Abbas, "I ask you both by Allah, do you know this?"They said, "Yes."Umar continued, "Then Allah took His Prophet ﷺ, and Abu Bakr said, 'I am the successor of the Messenger of Allah ﷺ.' So he took charge of it and did with it what the Messenger of Allah ﷺ had done. Then Allah took Abu Bakr, and I said, 'I am the successor of the successor of the Messenger of Allah ﷺ.' So I held it for two years, doing with it what the Messenger of Allah ﷺ and Abu Bakr had done. Then the two of you came to me, speaking with one voice, your case united. You came asking me for your share from your nephew, and this man came asking me for his wife's share from her father. I said, if you wish, I will hand it over to you on that condition. Now you seek from me a different ruling. By Allah, by whose permission the heavens and the earth stand firm, I will give no ruling on it other than that until the Hour comes. If you two are unable to manage it, then hand it back to me and I will take care of it for you."
Bukhari narrated it in the Book of Military Expeditions (4033) and in the Book of Inheritance (6728), and Muslim narrated it in jihad and Expeditions (1757:49), both from the hadith of Zuhri, who said, Malik bin Aws bin Hadathan informed me, and then he related it. The wording given here is that of Bukhari, and the wording of Muslim is similar.
