Ibn Khuzayma (2750), Ibn Hibban (3837), Hakim (1/460), and Bayhaqi (5/86) all narrated it through the route of Abbas bin Muhammad Duri, who said, Abu Ghassan Malik bin Ismail bin Dirham narrated to us, Abdul-Salam bin Harb informed us, from Shuba, from Asim, from Shaybi, from Ibn Abbas, and he related it.Hakim said, "This is a singular hadith that is sahih, and the two of them did not narrate it with this wording." Ibn Khuzayma said, "The permission to drink during tawaf holds if the report is established, but I have doubts about this chain of transmission, and I fear that Abdul-Salam or someone after him erred in this wording, meaning his saying 'during tawaf'."I say, Abdul-Salam bin Harb is Malai, one of the men relied upon by the community of hadith scholars, and there is disagreement about him, but his hadith is hasan when there is nothing objectionable in it, and we have found something that corroborates his hadith.For this reason Ibn Turkmani took issue with Bayhaqi's statement, following his teacher Hakim, "This is singular with this wording." Ibn Turkmani said, "Its chain of transmission is good, and Bayhaqi's teacher in this is Hakim, who narrated it in his Mustadrak and graded it sahih, and Ibn Hibban also narrated it in his Sahih from Harun bin Isa, from Ibn Abbas with his chain. It does not follow from Bayhaqi's saying 'singular' that it is not established, and it is corroborated by what Ibn Abu Shayba narrated in his Musannaf (4/412), where he said, Yahya bin Yaman told me, from Sufyan, from Mansur, from Khalid bin Saad, from Abu Masud, that he asked for water while circling the House, so a bucket of the date drink of the Siqaya was brought to him, and he drank it." End of quote.I say, in it is Khalid bin Saad, who is Kufi, the freed slave of Abu Masud Ansari, and there is disagreement about him, and Bukhari mentioned this hadith in Tarikh Awsat with this chain and said, "It is not sahih." Ibn Adi mentioned it in Kamil (3/900) among his objectionable narrations.Ibn Hajar said in Tahdhib al-Tahdhib (943), "Yahya bin Saeed narrated it from Sufyan as a stopped report, and that is the sahih view."Abdul-Razzaq (9796) and Ibn Abu Shayba narrated, through the route of Ibn Abu Layla, from Ikrima bin Khalid, who said, an elder from the family of Wadaa informed me, "that the Prophet ﷺ drank while he was circling the House." This has two defects. The first, Ibn Abu Layla has poor memory. The second, the elder from the family of Wadaa is unknown, and he did not clearly state that he heard it directly from the Prophet ﷺ.Bayhaqi related from Shafii that he said, "It is narrated through a route that is not established, that the Prophet ﷺ drank while circling." Ibn Turkmani said, "Perhaps this hadith, that is, the hadith of the elder from the family of Wadaa, is what Shafii meant, for it has two defects." He then mentioned them both, and denied that Shafii meant by it the hadith of Ibn Abbas with which we opened this chapter.Ibn Abbas, Ataa, Tawus, Mujahid, and Thawri saw no harm in a man drinking while circling the House, as Ibn Abu Shayba and Abdul-Razzaq mentioned about them in their respective Musannaf works.
