A man from Iraq said to him, "Ask Urwa bin Zubayr on my behalf about a man who enters the state of ihram for Hajj. When he performs tawaf around the Kaaba, may he exit the state of ihram or not? If he tells you no, then tell him that a certain man says he may."He said, "So I asked him, and he replied, 'One who enters ihram for Hajj does not exit it except by completing the Hajj.'"I said, "But a certain man says otherwise."He said, "What an evil thing he has said!"The man then approached me and asked me what had happened, so I told him. He said, "Tell him that a certain man reports that the Messenger of Allah ﷺ did exactly that, and what about Asma and Zubayr, who also did so?"So I went back to him and mentioned this. He asked, "Who is this man?"I said, "I do not know."He said, "Why does he not come to me himself and ask me? I suspect he is an Iraqi."I said, "I do not know."He said, "He has lied. The Messenger of Allah ﷺ performed Hajj, and Ayesha told me that the very first thing he did when he arrived in Mecca was to perform ablution and then make tawaf around the Kaaba. Then Abu Bakr performed Hajj, and the first thing he did was tawaf around the Kaaba, and he did nothing else beyond that. Then Umar did the same. Then Uthman performed Hajj, and I saw that the first thing he did was tawaf around the Kaaba, and he did nothing else beyond that. Then Muawiya and Abdullah bin Umar did likewise. Then I performed Hajj with my father, Zubayr bin Awwam, and the first thing he did was tawaf around the Kaaba, and he did nothing else beyond that. Then I saw the Muhajirun and the Ansar doing the same, and they did nothing else beyond that. The last person I saw doing this was Ibn Umar, and he did not break his Hajj into an Umrah. Ibn Umar is right there with them. Why do they not ask him? Not one of those who came before would begin with anything before tawaf around the Kaaba once their feet had set down, and they would not exit the state of ihram afterward. I saw my mother and my aunt as well, when they would arrive, they would begin with nothing before the Kaaba, performing tawaf around it, and they would not exit ihram. My mother told me that she, her sister, Zubayr, and so-and-so came intending Umrah, and once they touched the Corner they exited ihram. The man has lied in what he claims."
أن رجلا من أهل العراق قال له: سل لي عروة بن الزبير عن رجل بهل بالحج فإذا طاف بالبيت أيجل أم لا؟ فإن قال لك: لا يحل، فقل له إن رجلا يقول ذلك. قال: فسألته، فقال: لا يحل من أهل بالحج إلا بالحج. قلت: فإن رجلا كان يقول ذلك. قال: بئس ما قال! فتصداني الرجل فسألني فحدثته، فقال: فقل له: فإن رجلا كان يخبر أن رسول الله ﷺ قد فعل ذلك، وما شأن أسماء والزبير قد فعلا ذلك؟ قال: فجئته فذكرت له ذلك، فقال: من هذا؟ فقلت: لا أدري. قال: فما باله لا يأتيني بنفسه يسألني أظنه عراقيا؟ قلت: لا أدري! قال: فإنه قد كذب قد حج رسول الله ﷺ فأخبرتني عائشة رضي الله عنها أن أول شيء بدأ به حين قدم مكة أنه توضأ ثم طاف بالبيت، ثم حج أبو بكر فكان أول شيء بدأ به الطواف بالبيت ثم لم يكن غيره، ثم عمر مثل ذلك، ثم حج عثمان فرأيته أول شيء بدأ به الطواف بالبيت، ثم لم يكن غيره، ثم معاوية وعبد الله بن عمر، ثم حججت مع أبي: الزبير بن العوام فكان أول شيء بدأ به الطواف بالبيت، ثم لم يكن غيره، ثم رأيت المهاجرين والأنصار يفعلون ذلك ثم لم يكن غيره، ثم آخر من رأيت فعل ذلك ابن عمر ثم لم ينقضها بعمرة وهذا ابن عمر عندهم أفلا يسألونه؟ ولا أحد ممن مضى ما كانوا يبدوون بشيء حين يضعون أقدامهم أول من الطواف بالبيت، ثم لا يحلون وقد رأيت أمي وخالتي حين تقدمان لا تبدان بشيء أول من البيت تطوفان به ثم لا تحلان، وقد أخبرتني أمي أنها أقبلت هي وأختها والزبير وفلان وفلان بعمرة قط فلما مسحوا الركن خلوا وقد كذب فيما ذكر من ذلك.
Bukhari narrated it in the book of Hajj (1641), and Muslim in the book of Hajj (1235), both through the route of Ibn Wahb, who said, Amr bin Harith informed me, from Muhammad bin Abdul-Rahman bin Nawfal Qurashi, and he mentioned it, and the wording given here is that of Muslim.His statement, "then the two of them do not become permissible," means this applies whether their state of ihram was for Hajj alone or for combining Hajj and Umrah together, contrary to those who said that whoever performs Hajj alone becomes free from ihram once he completes the tawaf, as has been reported from Ibn Abbas.
