Ibn Abbas used to say, "No one performs tawaf around the House, whether a pilgrim or otherwise, except that he has come out of ihram."I asked Ata, "On what basis does he say that?"He replied, "From the saying of Allah Most High, 'Then their place of sacrifice is at the Ancient House' [Hajj 22:33]."I said, "But that is after standing at Arafah."He said, "Ibn Abbas used to say it applies both after Arafah and before it. He derived this from the command of the Prophet ﷺ when he ordered his companions to come out of ihram during the Farewell Pilgrimage."
كان ابن عباس يقول: لا يطوف بالبيت حاج ولا غير حاج إلا حل. قلت لعطاء: من أبن يقول ذلك؟ قال: من قول الله تعالى: {ثم محلها إلى البيت العتيق}. قال: قلت: فإن ذلك بعد المعرف. فقال: كان ابن عباس يقول: هو بعد المعرف وقبله، وكان يأخذ ذلك من أمر النبي ﷺ حين أمرهم أن يحلوا في حجة الوداع.
Bukhari narrated it in Maghazi (4396), and Muslim in Hajj (1245), both of them through the route of Ibn Jurayj, who said, "Atta narrated to me," and he related it. The wording here is Muslim's. His statement, "after the mawqif" means after standing at Arafah.
