Muaz bin Jabal came to us in Yemen as a teacher and a governor. We asked him about a man who died leaving behind his daughter and his sister. He gave the daughter half and the sister half.
أتانا معاذ بن جبل باليمن معلما وأميرا، فسألنا عن رجل توفي وترك ابنته وأخته. فأعطى الابنة النصف، والأخت النصف.
Bukhari (6734) narrated it from Mahmud, who said, "Abu Nadr told us, Abu Muawiya Shayban told us, from Ashath, from Aswad bin Yazid," and mentioned it.He also narrated it (6741) through Shuba, from Sulayman Amash, from Ibrahim, from Aswad, who said, "Muaz bin Jabal ruled among us in the time of the Messenger of Allah ﷺ that the daughter gets half and the sister gets half."Then Sulayman said, "He ruled among us," without mentioning "in the time of the Messenger of Allah ﷺ."Amash mentioned "in the time of the Prophet ﷺ" on one occasion and left it out on another, but there is no hesitation on his part about this. It has been established through other routes that "this took place while the Prophet ﷺ was still alive."
