Abdullah bin Harith reported,

My father Harith was overseeing one of the affairs of Mecca during the time of Uthman. Uthman came to Mecca.Abdullah bin Harith said, "I went out to receive Uthman at his lodging in Qudayd. The people of that watering place had hunted a partridge, so we cooked it with water and salt and made it into a broth for tharid. We presented it to Uthman and his companions, but they held back."Uthman said, "It is game I did not hunt and did not order to be hunted. People not in the state of ihram hunted it and fed it to us, so there is no harm."Uthman then asked, "Who can give a ruling on this?"They said, "Ali."So he sent for Ali , and he came.Abdullah bin Harith said, "It is as if I can still see Ali when he arrived, brushing leaves of khabat from his hands."Uthman said to him, "It is game we did not hunt and did not order to be hunted. People not in the state of ihram hunted it and fed it to us, so there is no harm."Ali became angry and said, "I adjure by Allah any man who witnessed the Messenger of Allah ﷺ when the leg of a wild donkey was brought to him, and the Messenger of Allah ﷺ said, 'We are a people in the state of ihram, so feed it to people not in ihram.'"Twelve men from the companions of the Messenger of Allah ﷺ bore witness to this.Then Ali said, "I adjure by Allah any man who witnessed the Messenger of Allah ﷺ when ostrich eggs were brought to him, and the Messenger of Allah ﷺ said, 'We are a people in the state of ihram, feed them to people not in ihram.'"Fewer than the previous twelve bore witness to this.Uthman then turned his side away from the food and entered his quarters, and the food was eaten by the people of that watering place.

حدثنا هاشم حدثنا سليمان يعني ابن المغيرة عن علي بن زيد قال

عبد الله بن الحارث بن نوفل الهاشمي قال

كان أبي الحارث على أمر من أمور مكة في زمن عثمان فأقبل عثمان رضي الله عنه إلى مكة فقال عبد الله بن الحارث فاستقبلت عثمان بالنزل بقديد فاصطاد أهل الماء حجلا فطبخناه بماء وملح فجعلناه عراقا للثريد فقدمناه إلى عثمان وأصحابه فأمسكوا فقال عثمان صيد لم أصطده ولم آمر بصيده اصطاده قوم حل فأطعموناه فما بأس فقال عثمان من يقول في هذا فقالوا علي فبعث إلى علي رضي الله عنه فجاء قال عبد الله بن الحارث فكأني أنظر إلى علي حين جاء وهو يحت الخبط عن كفيه فقال له عثمان صيد لم نصطده ولم نأمر بصيده اصطاده قوم حل فأطعموناه فما بأس قال فغضب علي وقال أنشد الله رجلا شهد رسول الله ﷺ حين أتي بقائمة حمار وحش فقال رسول الله ﷺ إنا قوم حرم فأطعموه أهل الحل قال فشهد اثنا عشر رجلا من أصحاب رسول الله ﷺ ثم قال علي أشهد الله رجلا شهد رسول الله ﷺ حين أتي ببيض النعام فقال رسول الله ﷺ إنا قوم حرم أطعموه أهل الحل قال فشهد دونهم من العدة من الاثني عشر قال فثنى عثمان وركه عن الطعام فدخل رحله وأكل ذلك الطعام أهل الماء
