The Messenger of Allah ﷺ said, "Whoever kills a believer intentionally is to be handed over to the relatives of the slain. If they wish, they may kill him, and if they wish, they may take the blood-money, which is thirty hiqqahs, thirty jadhaahs, and forty pregnant she-camels. That is the blood-money for intentional killing. Whatever they settle upon belongs to them, and that is the severe blood-money.The blood-money for quasi-intentional killing is heavier, like the blood-money for intentional killing, but the perpetrator is not killed for it. This is when Satan stirs up trouble between people, resulting in bloodshed without prior enmity or the carrying of weapons, for the Messenger of Allah ﷺ said, meaning, whoever bears arms against us is not one of us, nor was there any lying in wait on a road. So whoever kills under circumstances other than these, it is quasi-intentional. Its blood-money is heavier, but the perpetrator is not killed. This applies during the sacred month, in the sacred precinct, and concerning a neighbor.Whoever kills by mistake, his blood-money is one hundred camels, thirty bint-makhads, thirty bint-labuns, thirty hiqqahs, and ten young male ibn-labuns."He said, "The Messenger of Allah ﷺ used to set it for the people of the towns at four hundred Dinars or its equivalent in silver. He would set it according to the prices of camels. When prices rose, he raised its value, and when they fell, he reduced its value, according to the time. During the era of the Messenger of Allah ﷺ it ranged between four hundred and eight hundred Dinars, or its equivalent in silver, eight thousand dirhams.He decreed that whoever's blood-money was due from people of cattle, it was two hundred cows, and he decreed that whoever's blood-money was due from people of sheep, it was two thousand sheep.He decreed concerning the nose, if it is severed entirely, the full blood-money, and if its tip is cut off, half the blood-money.He decreed for the eye half the blood-money, fifty camels or its equivalent in gold or silver, or one hundred cows, or one thousand sheep. For the leg, half the blood-money. For the hand, half the blood-money. For a wound that reaches the brain membrane, a third of the blood-money, thirty-three camels or their value in gold, silver, cattle, or sheep. For a wound that penetrates the body cavity, a third of the blood-money. For a wound that displaces the bone, fifteen camels. For a wound that exposes the bone, five camels. For the teeth, five camels."
حدثنا يعقوب حدثنا أبي عن محمد بن إسحاق فذكر حديثا قال ابن إسحاق وذكر عمرو بن شعيب بن
قال رسول الله ﷺ من قتل مؤمنا متعمدا فإنه يدفع إلى أولياء القتيل فإن شاءوا قتلوا وإن شاءوا أخذوا الدية وهي ثلاثون حقة وثلاثون جذعة وأربعون خلفة فذلك عقل العمد وما صالحوا عليه من شيء فهو لهم وذلك شديد العقل وعقل شبه العمد مغلظة مثل عقل العمد ولا يقتل صاحبه وذلك أن ينزغ الشيطان بين الناس فتكون دماء في غير ضغينة ولا حمل سلاح فإن رسول الله ﷺ قال يعني من حمل علينا السلاح فليس منا ولا رصد بطريق فمن قتل على غير ذلك فهو شبه العمد وعقله مغلظة ولا يقتل صاحبه وهو بالشهر الحرام وللحرمة وللجار ومن قتل خطأ فديته مائة من الإبل ثلاثون ابنة مخاض وثلاثون ابنة لبون وثلاثون حقة وعشر بكارة بني لبون ذكور قال وكان رسول الله ﷺ يقيمها على أهل القرى أربع مائة دينار أو عدلها من الورق وكان يقيمها على أثمان الإبل فإذا غلت رفع في قيمتها وإذا هانت نقص من قيمتها على عهد الزمان ما كان فبلغت على عهد رسول الله ﷺ ما بين أربع مائة دينار إلى ثمان مائة دينار وعدلها من الورق ثمانية آلاف درهم وقضى أن من كان عقله على أهل البقر في البقر مائتي بقرة وقضى أن من كان عقله على أهل الشاء فألفي شاة وقضى في الأنف إذا جدع كله بالعقل كاملا وإذا جدعت أرنبته فنصف العقل وقضى في العين نصف العقل خمسين من الإبل أو عدلها ذهبا أو ورقا أو مائة بقرة أو ألف شاة والرجل نصف العقل واليد نصف العقل والمأمومة ثلث العقل ثلاث وثلاثون من الإبل أو قيمتها من الذهب أو الورق أو البقر أو الشاء والجائفة ثلث العقل والمنقلة خمس عشرة من الإبل والموضحة خمس من الإبل والأسنان خمس من الإبل
