He asked Ibn Umar about a man who divorced his wife while she was menstruating.Ibn Umar replied, "Do you know Abdullah bin Umar? He divorced his wife while she was menstruating, so Umar went to the Messenger of Allah ﷺ and informed him of that. The Messenger of Allah ﷺ said, 'Order him to take her back, then if he later decides to divorce her, let him divorce her at the beginning of her waiting period.'"Ibn Bakr said, "Or at the beginning of her period of purity."I asked Ibn Umar, "Was that divorce counted as a divorce?"He answered, "Yes. What do you think if he was unable or acted foolishly?"

أنه سأل ابن عمر عن رجل طلق امرأته وهي حائض فقال أتعرف عبد الله بن عمر فإنه طلق امرأته حائضا فانطلق عمر إلى رسول الله ﷺ فأخبره بذلك فقال رسول الله ﷺ مره فليراجعها ثم إن بدا له طلاقها طلقها في قبل عدتها قال ابن بكر أو في قبل طهرها فقلت لابن عمر أيحسب طلاقه ذلك طلاقا قال نعم أرأيت إن عجز واستحمق
Its isnad is sahih, and it is a longer version of 4789, an abridgment of 4500. Istahmaqa (acted foolishly), Ibn Athir said, it is said, "istahmaqa the man," when he acted the way fools act, and "istahmaqtuhu" means I found him to be a fool, and the verb is used both intransitively and transitively, like "istawqara the camel." It is also transmitted as "ustuhmiqa," in the passive form, but the first reading is preferable, so that it corresponds with "ajaza."
