The Messenger of Allah ﷺ said, "Whoever sells palm trees that have already been pollinated, the fruit belongs to the seller unless the buyer stipulates otherwise."
حدثنا إسماعيل أخبرنا أيوب عن نافع
قال رسول الله ﷺ من باع نخلا قد أبرت فثمرتها للبائع إلا أن يشترط المبتاع
Its isnad is sahih. It was narrated by the entire group, as in Muntaqa 2849.Ubbirat, with the ba kasrah, whether lightened or doubled, means it was pollinated. Ibn Athir said, "Ubbirat an-nakhlah and abbartuha, so it is either mabura or muabbara, and the noun form is ibar."
