Qabisa bin Zuayb reported,

Qabisa reported that the daughter of Saeed bin Zayd bin Amr bin Nufayl, whose maternal aunt was Fatimah bint Qays, had been married to Abdullah bin Amr bin Uthman, and he divorced her three times. Her aunt Fatimah bint Qays sent for her and moved her to her own house. Marwan bin Hakam was then governor of Madinah.Qabisa said, "Marwan sent me to her, and I asked her what had led her to move a woman out of her house before her waiting period was over."She replied, "Because the Messenger of Allah ﷺ instructed me to do so."Then she related her own story to me and said, "I argue my case against you from the Book of Allah. Allah says in His Book, 'When you divorce women, divorce them for their waiting period, and count the waiting period, and fear Allah your Lord. Do not expel them from their houses, nor should they leave, unless they commit a clear act of indecency' ... 'perhaps Allah will bring about after that a new situation' [Talaq 65:1]. Then Allah says, 'And when they have reached their term', meaning the third divorce, 'then retain them in kindness or part with them in kindness' [Talaq 65:2]. By Allah, Allah mentioned no confinement after the third divorce, quite apart from what the Messenger of Allah ﷺ instructed me to do."Qabisa said, "I went back to Marwan and told him what she had said."Marwan said, "A woman's report. A woman's report."Then he gave orders concerning the woman, and she was returned to her house until her waiting period was complete.

قبيصة بن ذؤيب

حدثه أن بنت سعيد بن زيد بن عمرو بن نفيل وكانت فاطمة بنت قيس خالتها وكانت عند عبد الله بن عمرو بن عثمان طلقها ثلاثا فبعثت إليها خالتها فاطمة بنت قيس فنقلتها إلى بيتها ومروان بن الحكم على المدينة قال قبيصة فبعثني إليها مروان فسألتها ما حملها على أن تخرج امرأة من بيتها قبل أن تنقضي عدتها قال فقالت لأن رسول الله ﷺ أمرني بذلك قال ثم قصت علي حديثها ثم قالت وأنا أخاصمكم بكتاب الله يقول الله عز وجل في كتابه {إذا طلقتم النساء فطلقوهن لعدتهن وأحصوا العدة واتقوا الله ربكم لا تخرجوهن من بيوتهن ولا يخرجن إلا أن يأتين بفاحشة مبينة إلى لعل الله يحدث بعد ذلك أمرا} ثم قال الله عز وجل {فإذا بلغن أجلهن} الثالثة {فأمسكوهن بمعروف أو سرحوهن بمعروف} والله ما ذكر الله بعد الثالثة حبسا مع ما أمرني به رسول الله ﷺ قال فرجعت إلى مروان فأخبرته خبرها فقال حديث امرأة حديث امرأة قال ثم أمر بالمرأة فردت إلى بيتها حتى انقضت عدتها
