Abu Shurayh said to Amr bin Saeed, while he was dispatching troops to Makkah, "Permit me, commander, to relate to you a statement made by the Messenger of Allah ﷺ on the day after the conquest of Makkah. My ears heard it, my heart retained it, and my eyes saw him as he spoke. He praised Allah and extolled Him, then said, 'Makkah was made sacred by Allah, not by people. So it is not lawful for anyone who believes in Allah and the Last Day to shed blood within it or to cut down its trees. If anyone seeks license to fight in it on the grounds that the Messenger of Allah ﷺ fought there, tell him that Allah permitted His Messenger but did not permit you. He permitted me only for a brief hour of one day, and its sanctity has returned today as it was yesterday. Let the one present convey this to the one absent.'"Abu Shurayh was asked, "What did Amr say to you?"He replied, "He said, 'I know that better than you, Abu Shurayh. The sacred precinct does not grant refuge to a sinner, nor to one fleeing with bloodshed, nor to one fleeing from the jizyah.'"Hajjaj likewise said, "with jizyah." And Yaqub narrated from his father, from Ibn Ishaq, "nor one who refuses the jizyah."
حدثنا أبو كامل قال حدثنا ليث قال حدثني سعيد بن أبي سعيد المقبري
لعمرو بن سعيد وهو يبعث البعوث إلى مكة ائذن لي أيها الأمير أحدثك قولا قام به رسول الله ﷺ الغد من يوم الفتح سمعته أذناي ووعاه قلبي وأبصرته عيناي حيث تكلم به أنه حمد الله وأثنى عليه ثم قال إن مكة حرمها الله ولم يحرمها الناس فلا يحل لامرئ يؤمن بالله واليوم الآخر أن يسفك فيها دما ولا يعضد فيها شجرة فإن أحد ترخص بقتال رسول الله ﷺ فيها فقولوا إن الله عز وجل أذن لرسوله ولم يأذن لكم وإنما أذن لي فيها ساعة من نهار وقد عادت حرمتها اليوم كحرمتها بالأمس فليبلغ الشاهد الغائب فقيل لأبي شريح ما قال لك عمرو قال قال أنا أعلم بذلك منك يا أبا شريح إن الحرم لا يعيذ عاصيا ولا فارا بدم ولا فارا بجزية وكذلك قال حجاج بجزية وقال يعقوب عن أبيه عن ابن إسحاق ولا مانع جزية
