Maez bin Malik was under the guardianship of my father, and he had relations with a slave girl from the tribe. My father said to him, "Go to the Messenger of Allah ﷺ and tell him what you have done. Perhaps he will seek forgiveness for you." He intended by this only the hope that there would be a way out for him.So he went to him and said, "Messenger of Allah, I have committed adultery, so apply to me the prescribed punishment in the Book of Allah."The Messenger of Allah ﷺ turned away from him.Then he came to him a second time and said, "Messenger of Allah, I have committed adultery, so apply to me the prescribed punishment in the Book of Allah."Then he came to him a third time and said, "Messenger of Allah, I have committed adultery, so apply to me the prescribed punishment in the Book of Allah."Then he came to him a fourth time and said, "Messenger of Allah, I have committed adultery, so apply to me the prescribed punishment in the Book of Allah."The Messenger of Allah ﷺ said, "You have said it four times now. With whom?"He replied, "With so-and-so."The Prophet asked, "Did you lie down with her?"He answered, "Yes."The Prophet asked, "Did you have intimate contact with her?"He answered, "Yes."The Prophet asked, "Did you have intercourse with her?"He answered, "Yes."So the Prophet ordered that he be stoned. He was taken out to the Harrah, and when he was being stoned and felt the impact of the stones, he panicked and fled, running swiftly. Abdullah bin Unays met him after Maez had outrun his other pursuers. He pulled out the leg-bone of a camel and threw it at him, killing him.Then he came to the Prophet ﷺ and reported what had happened. The Prophet said, "Why did you not leave him? Perhaps he would have repented and Allah would have accepted his repentance."Hisham said, Yazid bin Naeem bin Hazal narrated to me from his father that the Messenger of Allah ﷺ said to my father when he saw him, "By Allah, Hezal, had you covered him with your garment, it would have been better than what you did with him."
حدثنا وكيع حدثنا هشام بن سعد أخبرني
كان ماعز بن مالك في حجر أبي فأصاب جارية من الحي فقال له أبي ائت رسول الله ﷺ فأخبره بما صنعت لعله يستغفر لك وإنما يريد بذلك رجاء أن يكون له مخرج فأتاه فقال يا رسول الله إني زنيت فأقم علي كتاب الله فأعرض عنه ثم أتاه الثانية فقال يا رسول الله إني زنيت فأقم علي كتاب الله ثم أتاه الثالثة فقال يا رسول الله إني زنيت فأقم علي كتاب الله ثم أتاه الرابعة فقال يا رسول الله إني زنيت فأقم علي كتاب الله فقال رسول الله ﷺ إنك قد قلتها أربع مرات فبمن قال بفلانة قال هل ضاجعتها قال نعم قال هل باشرتها قال نعم قال هل جامعتها قال نعم قال فأمر به أن يرجم قال فأخرج به إلى الحرة فلما رجم فوجد مس الحجارة جزع فخرج يشتد فلقيه عبد الله بن أنيس وقد أعجز أصحابه فنزع له بوظيف بعير فرماه به فقتله قال ثم أتى النبي ﷺ فذكر ذلك له فقال هلا تركتموه لعله يتوب فيتوب الله عليه قال هشام فحدثني يزيد بن نعيم بن هزال عن أبيه أن رسول الله ﷺ قال لأبي حين رآه والله يا هزال لو كنت سترته بثوبك كان خيرا مما صنعت به
