Rifa bin Rafi reported,

Zuhayr said in his narration that Rifa bin Rafi, who was among those who pledged at Aqaba and fought at Badr, said,I was with Umar when it was said to him that Zayd bin Thabit was giving fatwas to the people in the mosque. Zuhayr added in his narration, "to the people, based on his own opinion, regarding a man who has intercourse but does not ejaculate."Umar said, "Bring him to me at once."So he was brought, and Umar said, "Enemy of yourself! Have you reached the point of giving fatwas to the people in the mosque of the Messenger of Allah ﷺ based on your own opinion?"Zayd replied, "I did not do that. Rather, my uncles narrated to me from the Messenger of Allah ﷺ."Umar asked, "Which of your uncles?"He answered, "Ubayy bin Kaab," and Zuhayr added in his version, "Abu Ayub and Rifa bin Rafi."So Umar turned to me and said, "What does this young man say?" Zuhayr's wording was, "What does this lad say?"I said, "We used to do it during the time of the Messenger of Allah ﷺ."Umar asked, "Did you ask the Messenger of Allah ﷺ about it?"I said, "We used to do it during his lifetime and did not perform ghusl."So Umar gathered the people, and they agreed that water is only required because of water, except for two men, Ali bin Abu Talib and Muaz bin Jabal, who said, "When the circumcised parts meet, ghusl becomes obligatory."Ali said, "Commander of the Believers, the most knowledgeable people about this matter are the wives of the Messenger of Allah ﷺ."So Umar sent for Hafsah, and she said, "I have no knowledge of it."Then he sent for Ayesha, and she said, "When the circumcised parts meet, ghusl becomes obligatory."So Umar became furious, then said, "Word must not reach me that anyone has done this without performing ghusl, or I will punish him severely."

قال حدثنا يحيى بن آدم قال حدثنا زهير وابن إدريس عن محمد بن إسحاق عن يزيد بن أبي حبيب عن معمر بن أبي حبيبة

عن عبيد بن رفاعة بن رافع عن أبيه قال

زهير في حديثه رفاعة بن رافع وكان عقبيا بدريا قال كنت عند عمر فقيل له إن زيد بن ثابت يفتي الناس في المسجد قال زهير في حديثه الناس برأيه في الذي يجامع ولا ينزل فقال أعجل به فأتي به فقال يا عدو نفسه أوقد بلغت أن تفتي الناس في مسجد رسول الله ﷺ برأيك قال ما فعلت ولكن حدثني عمومتي عن رسول الله ﷺ قال أي عمومتك قال أبي بن كعب قال زهير وأبو أيوب ورفاعة بن رافع فالتفت إلى ما يقول هذا الفتى وقال زهير ما يقول هذا الغلام فقلت كنا نفعله في عهد رسول الله ﷺ قال فسألتم عنه رسول الله ﷺ قال كنا نفعله على عهده فلم نغتسل قال فجمع الناس واتفق الناس على أن الماء لا يكون إلا من الماء إلا رجلين علي بن أبي طالب ومعاذ بن جبل قالا إذا جاوز الختان الختان فقد وجب الغسل قال فقال علي يا أمير المؤمنين إن أعلم الناس بهذا أزواج رسول الله ﷺ فأرسل إلى حفصة فقالت لا علم لي فأرسل إلى عائشة فقالت إذا جاوز الختان الختان وجب الغسل قال فتحطم عمر يعني تغيظ ثم قال لا يبلغني أن أحدا فعله ولا يغسل إلا أنهكته عقوبة
