A group of men had relations with a woman during a single period of purity. Ali, may Allah be pleased with him, said to two of them, "Are you willing to concede the child to these two?"They said, "No."He turned to the other two and asked, "Are you willing to concede the child to these two?"They said, "No."He said, "You are quarrelsome partners. I will draw lots between you. Whoever's lot is drawn, I will impose on him two-thirds of the blood-money and assign the child to him."This was mentioned to the Prophet ﷺ, and he said, "I know nothing other than what Ali, may Allah be pleased with him, has said."
حدثنا سفيان بن عيينة عن أجلح عن الشعبي عن عبد الله بن أبي الخليل
أن نفرا وطئوا امرأة في طهر فقال علي رضي الله تعالى عنه لاثنين منهم أتطيبان نفسا لذا فقالا لا فأقبل على الآخرين فقال أتطيبان نفسا لذا فقالا لا قال أنتم شركاء متشاكسون قال إني مقرع بينكم فأيكم قرع أغرمته ثلثي الدية وألزمته الولد قال فذكر ذلك للنبي ﷺ فقال لا أعلم إلا ما قال علي رضي الله تعالى عنه
